🌸90 DAY WARRANTY🌸
Once you are satisfied with your avatar, and the commission process ends, up to 90 days after I will continue to provide support if the issue arises that an update causes issues for the model/Unity file.
This does not include any other custom modifications made that are NOT included within the warranty. Updates and fixes will be made to the original Unity Project last sent to the client.🌸Monetary Content🌸
Monetary content is defined as:
Creation and distribution of digital end products shared to commercial and monetized social and content platform accounts belonging to the LicenseeCredit to the artist is required for all public usesMonetary content rights do NOT include:
Creation and re-selling of value-add or derivative digital or physical end products made with the commissioned asset by the Licensee
Claiming credit, ownership, or copyright over the commissioned assetMonetary Content rights, such as but not limited to: Streaming/VTubing, will be +50% of the base price. Any other commercial rights, please message me for more details.🌸Commercial Rights🌸

Listed avatar base prices are meant for PERSONAL/NON-PROFIT USE
I currently do NOT offer VTuber conversion (outside of providing face tracking blendshapes/shapekeys ready for the model). However, if you are interested in VTubing with such model, please purchase the "Monetary Content" rights BEFORE doing so.
Failure to do so will result in a violation of the terms and services.Avatars can range from Good-Very Poor VRC performance ranking, depending on poly count, phys-bones, etc.
If you wish for a specific performance rank, please message BEFORE ordering.Once I have received that it is ok to proceed per avatar update, OR I have not heard back in 5 days, I will proceed and will be unable to make changes needed to be made at the previous stage
(Ex: cannot edit model propositions once texturing has begun)Finished avatars images are allowed to be used for social media and listing examples by the artist, SquinkArts.The creation and usage of works for NFTs, any and all algorithmic generative training, and/or AI generation in any way, through imagery of the model or through file sharing, is strictly prohibited in all cases.I, the artist:
- Hold all rights to turn down any commission for any reason if I am unable or uncomfortable to go through with it at any time.- Retain proper copyrights over commissioned works- Retain the right to use the commissioned piece for imagery for showcase
(such as, social media, listings, etc)- Will NOT claim creatorship of the character provided of the commissioned artwork (unless designed by myself)- Will NOT continue to make a profit off of the finished commission unless the buyer breaks any terms- Due to the nature of the piece, once the commission process has begun, I cannot offer refunds.

YOU, the commissioner:
- May NOT use avatar for monetary content/ commercial purposes without proper agreement and payment of such rights- May NOT share avatar files
(If for commissioning another artist for edits, message me first)- Will NOT claim anyone other than Squinkarts as the creator of such model or remove artist credits- Will NOT use avatar for any of the following:- NFTs
- Any A.I. usage/training
- Any and all algorithmic generative training (through imagery or file sharing, or any other methods)
- Cryptocurrency/Bitcoin
- Offensive/Hateful/Political Use
- Illegal activities
- Public or private file sharing without both parties (artist and client) discussing and agreeing upon terms (Ex: Third party creating assets or making changes on model)
- Listing avatar as public within VRC or other media
- Share assets taken from avatar
- NSFW edits
- Claiming creatorship of avatar
- VTubing/ Streaming without purchasing monetary content rights
- Any type of non-disclosed and agreed upon by both parties (artist and client), streaming/profit, such as but not limited to: prints, reselling avatar files, merchandise, etc
- Unauthorized reselling or distribution of the model or (its) assets in any wayFailure to comply will result in the creator taking appropriate action, including but not limited to: DMCA, Blacklist/Ban from shop, Legal action, Etc.
